Terms of Service
These Terms of Service ("Terms") govern access to and use of the Aydera platform (website, family, professional and institution applications) by any user. By creating an account, you accept these Terms without reservation.
1. Service provider
The Aydera platform is provided by Aydera, established at Belgium. Application hosting: Railway (European Union). Web application hosting: Netlify. Contact: support@aydera.be.
2. Definitions
- Beneficiary: the person being cared for (may be the family account holder, or a relative/child represented by them — or a person cared for by an institution).
- Professional: a natural person practising a care profession (special-needs educator, care assistant, nurse, therapist, social worker, etc.), registered on the platform.
- Client: a family or an institution submitting a care request.
- Assignment: a care request created by a client, describing the need, frequency and location.
- On-site assistance: an assignment carried out at a fixed address (home, residence, institution premises).
- Mobile assistance: an assignment consisting of driving the beneficiary from a starting point to a destination (medical appointment, activity, etc.), where applicable with a return trip.
- Intervention: the actual carrying-out of an assignment, at a given date and time.
3. Aydera's role
Aydera is a trusted partner for medico-social care coordination: a platform connecting independent professionals with clients (families, institutions) who need care support.
Aydera is neither the employer of professionals, who practise independently (or under the status declared at registration), nor a care provider: interventions are carried out by the professional under their own professional responsibility, in accordance with the ethical and legal rules applicable to their profession.
Aydera verifies the documents submitted by each professional (identity, diploma, criminal record extract model 2, professional liability insurance, and where applicable driving licence) before activating their account, but does not substitute for any regulatory authority and does not guarantee the absence of any risk related to the intervention.
4. Mobile assistance and third-party partners
For mobile assistance assignments, Aydera may call on a professional registered on the platform or, where relevant, on an external transport partner (for example Family Cabs). In this second case, the trip is carried out by that partner under its own terms and its own transport insurance coverage; Aydera remains your point of contact for organising the assignment, but responsibility for the physical execution of the trip lies with the partner carrying it out.
5. Registration and account
Registration is open to adults (or duly represented institutions). You undertake to provide accurate information and to keep it up to date. You are responsible for the confidentiality of your credentials and for any activity carried out from your account.
A professional account is only activated after our team has verified the required documents. Authorisation for mobile assistance (where applicable) is subject to a separate validation, after submission of the driving licence.
6. Rates and payment
Intervention rates are shown on the platform before an assignment is confirmed. Families pay by SEPA direct debit or bank card via our payment provider Mollie; Aydera never stores your complete banking data. Institutions are billed according to the terms agreed during their qualification (monthly invoicing, PEPPOL where applicable).
7. User obligations
8. Cancellation and termination
Either party may cancel a scheduled assignment under the conditions indicated when it was created (notice period). Any user may delete their account at any time from their personal space; Aydera may suspend or terminate an account in the event of a breach of these Terms, fraud, or endangerment of a beneficiary or a professional.
9. Liability
Aydera makes every effort to ensure the quality of its matching service (document verification, matching tailored to declared needs) but is not a party to the care relationship itself and cannot be held liable for the acts or omissions of a professional or a third-party transport partner in carrying out an intervention, except for Aydera's own fault in selection or prior verification.
Aydera's liability for the operation of the platform itself (availability, accuracy of displayed information) is limited to direct and foreseeable damages, within the limits permitted by Belgian law.
10. Intellectual property
The Aydera brand, logo, text, interface and features of the platform are protected and remain the exclusive property of Aydera. Any unauthorised reproduction or use is prohibited.
11. Personal data
The processing of your personal data is described in our Privacy Policy, which forms an integral part of these Terms.
12. Complaints
Any complaint regarding the service may be sent to support@aydera.be, and for any question regarding your personal data to dpo@aydera.be. We undertake to respond within a reasonable time.
13. Governing law and jurisdiction
These Terms are governed by Belgian law. Any dispute relating to their interpretation or performance falls, failing an amicable resolution, under the exclusive jurisdiction of the Belgian courts.
14. Changes to the Terms
Aydera may amend these Terms to reflect legal, technical or service developments. The date of the last update is shown at the top of the document. Substantial changes will be notified to you by email before they take effect.
